In a major legal reversal, the U.S. Court of Appeals for the Fourth Circuit has reinstated the Department of Defense’s policy barring individuals living with HIV from enlisting in the U.S. military. The decision overturns a landmark 2024 ruling, with the three-judge panel citing “military deference” over modern medical science.
While plaintiffs argued that antiretroviral therapy (ART) renders the virus undetectable and allows for full physical readiness, the court held that the military’s concerns regarding combat-zone logistics and “walking blood banks” provided a rational basis for the categorical ban. Advocates from Lambda Legal and Minority Veterans of America (MVA) have slammed the decision, noting that it ignores decades of medical advancement and maintains a double standard for those already serving. As the legal battle for Isaiah Wilkins and others continues, this case appears headed for a full appellate review or a potential showdown at the U.S. Supreme Court.
